Something horrible happened recently to a Key West friend, which he announced on Facebook:
I have the most heartrending and horrific news to share with our friends, the last thing any parent wants to experience. My son, Jason, was found dead yesterday morning, in his van, in Rhode Island. The Medical Examiner will be conducting an autopsy soon.
I am devastated, grieving as nothing can prepare one for this shock, the inconsolable sadness, the bone-crushing pain. Your prayers and love for him and his passage is greatly sought and embraced. He was a deeply feeling, caring, smart, and sweet, soulful person. I can barely begin to say how ripped open and raw it feels right now, anguished, the tears, the torrents that are coursing through me as I must prepare to receive him, as he makes his new journey, and praying he will indeed rest, in peace, now.

A solitary yellow rose. I got directions at the cemetery office to the family plot, drove there, parked, got out, started walking toward my mother’s grave stone, at the foot of which was his unmarked grave, i had been told. I was literally dropped to my knees, bawling, heaving sobbing, after 20 years. I repeated that ritual maybe half dozen times before the emotions stopped bursting out of me. Then, I went to the cemetery office and asked for help designing a grave marker. Just a marker. A woman holding an infant. Well, Sancho, maybe if you had seen, heard and felt this Jester/Joker in ways I have directly in spirit experiences, and through his, or her, or its, unwitting usually but occasional willing human proxies or puppets, you might have a different point of view. The Devil certainly has a role to play in the Creation, but perhaps is not so detached and benevolent as you paint. You certainly come up against the Devil’s handiwork ongoing, I have heard you lament plenty about it over the years we have corresponded. Of course, what the Devil likes is for people to think being in a church is where the Devil ain’t, or for people, like the New Age, to think the Devil don’t exist. Flip sides of the same coin, I suppose, probably not too distantly related to that river in Egypt.

Moving to the Cudjoe Key bus stop on US 1 yesterday morning …
A fellow I had not seen on the bus before walked up to the bus stop just before the shuttle bus arrived. I don’t recall what led up to it, but I said the day before I had not been paying attention coming back to Cudjoe Key on the bus and the bus was on Summerland Key, the next island up US 1, before I woke up to my predicament. The fellow said he’d done much the same a while back, on the last nighttime bus up the keys, which stops in Marathon, and when he realized where he was, he was at Bahia Honda, way above Big Pine Key. He got off the bus there and started walking back toward Cudjoe Key, about 10 miles away. He had to stop and rest once on Big Pine Key, and eventually a sheriff deputy came by in his cruiser and stopped and asked him what an old man like him was doing out on the highway like that so late at night? After hearing what had happened, the deputy offered the old man a ride, and took him home.
I said, about the same thing happened to me. Walking back to Cudjoe Key from Summerland Key the day before, I tried hitching a ride, but no luck. Then I saw a deputy sheriff cruiser ahead on the right side of the road, parked in the shade of tall trees, shielding him from the afternoon sun. I walked up to his cruiser and told him what had happened, and why this old man was walking down US 1, and he said to get in the back seat, he’d take me down to Cutthorat Road, the turn to where I stay on Cudjoe, with a friend, which is the same turn the old fellow at the bus stop takes to get to where he stays with friends, also.
The deputy took a left, though, on Spanish Main, the first road on Cudjoe, and drove down it to the first interior road to the right, and turned down that road to Cuttthroat Road, where he let me out and nobody could see what he had done. En route to Cutthroat, I said I knew this side road well. Just a bit futher down it, I once was picked up by a biker chick. Really?, the deputy asked. Really, I said. And just the night before she had emailed me about maybe my girlfriend, who is in the county jail, and I maybe being able to stay in a home she owns on another key, if she can get problems with it straightened out. Maybe this is a sign, I told the kind deputy.
The old fellow at the bus stop said the deputy who helped him out said he wasn’t supposed to do it, but he was doing it anyway, because it was the right thing to do, and the reason he took the old man to where he stayed, instead of letting him out where Cutthorat comes into US 1, was so nobody would see what was happening.
On the bus, the old man sat across from me, and we talked some more. He’s on disability now, I didn’t ask why. I said I was disabled by God, and Social Security would not recognize that. But I’m on Social Security retirement benefits now, but that’s not as favorable as disability benefits, for then all of your medical is paid for, the old man said. The old man about my age, it seemed, 72.
When he said he once had been an air traffic controller, I said, well, that takes me back to when I practiced law in Birmingham, Alabama, and I tried an airplane crash case in federal court arising out of a single engine private airplane, a Cessna, crashing in socked-in conditions at Bates Field in Mobile, Alabama. The pilot, from Birmingham, his mistress, from Mobile, and the pilot’s scuba diving instructor, from Birmingham, all were killed. They were returning from scuba diving at John Peneekamp on Key Largo.
I said a Birmingham law firm representing the widow of the dead scuba diving instructor first got the case and collected all the insurance proceeds they could, then they referred the case to me, for me to sue the FAA. For the recording tape of the conversation between the pilot and the air traffic controller, which the FAA had given to the NTSB (National Transportation Safety Board, which investigates airplane crashes), had been tampered by the FAA deleting a crucial part of what the air traffic controller said when the pilot was on final approach. Ihe lawyers for the pilot’s insurance company had somehow obtained an untampered recording, and had given it to the law firm representing the estate of the dead scuba diving instructor, whose widow was that law firm’s client, and became my client.
Armed with that, I sued the US Government for the FAA, through its air traffic controller, contributing to the death of the widow’s husband, an innocent passenger.
The pilot was not instrument rated and did not tell the air traffic controller he was not instrument rated when he attempted an IFR (Instrument Flight Rules) approach into Bates Field in about zero visibility conditions. The FAA recording had the pilot finally telling the air traffic controller he did not have an approach plate on board, which is a chart/map for that particular airfield, showing runway vectors and the radio frequencies for the airfield and the localizer frequency. The localizer is a radio signal beaming out from a runway, which pilots use to let them know when they are headed correctly toward the runway. Without the localizer frequency, a pilot cannot find the runway under IFR conditions.
On the tape the FAA had provided to the NTSB, was the air traffic controller, after giving the pilot the localizer frequency, telling the pilot he was crossing the localizer and to get back on it. Then, to someone in the control tower, the controller grumbles he has a pilot on final approach who says he does not have an approach plate. That was what the FAA deleted from the recording the FAA gave to the NTS. In moments, the aircraft is no longer on the radar. It has crashed. Conversation about that is on the tape. All aboard the Cessna died. The arrogant idiot pilot, deserved it. His passengers did not.
The old man on the bus said, quite a few times he had declared an emergency for pilots. I said that was my theory in this case. One of my experts was a former air traffic controller, who testified that the air traffic controller at Bates Field knew he had a pilot who was not instrument rated on his hands. An instrument rated pilot without the approach plate would have notified the tower of that well in advance. My expert witness said the controller should have told the pilot this was an emergency, and to maintain wings level, and to climb, and from there he would be guided by the air traffic controller to safety.
The old man on the bus said he had done that a number of times for pilots, who were not instrument rated, and that’s what the controller at Bates Field should have done.
I said, the radar at Bates Field did not have a feature which showed the altitude of incoming aircraft, but only displayed the lateral motion.
I said there was an aircraft second in line behind the Cessna, being flown by a private corporation pilot, who was listening to the whole thing unfold on his radio, and when one of his passengers asked what was going on?, that pilot said a pilot who had no green card was trying to make an instrument landing in this awful weather. In aviation parlance, a green card was an IFR certificate. I said that commercial pilot was my other witness in the case, both as an expert and as an eye witness, or rather, an ear witness. After the crash, he got permission from the control tower to fly around and go up upstairs and calm down, before he landed at Bates Field.
So, despite the clear evidence that the FAA had tampered the recording, to get the damning part out of it, which, basically was my entire case, because tampering material evidence, under the rules of evidence, means the trier of fact, in this case, the judge, no jury trial permitted in Federal Tort Claim lawsuits against the US Government, is supposed to make every adverse inference against the evidence tamperer.
But this judge did not do that. This judge said the air traffic controller did not have any way of knowing how close to the ground the Cessna was, so he was ruling for the government.
I told the former air traffic controller on the bus, the judge was known as a fine jurist, but there was no way he was going to rule against the US Government in that case.
I said, it was interesting how the tampered tape proceeded through the run up to the trial. I was laying low about it. But at the pretrial hearing, the judge asked for stipulations of facts, and the FAA’s attorney and the local US Attorney asked for me to stipulate the FAA’s recording. I told the old man on the bus I maybe had not thought through that well, I probably should have been prepared to simply say the plaintiff stipulates that is the recording the FAA gave us, and hoped the defense and the judge would let that slide by, and not realize I was going to spring the real recording at trial, after setting up the FAA lawyer and the US Attorney, whom I was about positive had no clue what the FAA had done.
But, I did not do it that way. I told the judge, the FAA doctored its recording, deleted the damning part, I have the full recording. You could have heard a pin drop. The FAA attorney and the US Attorney were not breathing. They indeed had no clue what the FAA had done. They knew something terrible had just happened. The US Attorney asked for my recording, and I said I would provide a copy. The Judge okay’d that, said this would be dealt with further at the trial.
Shortly, the US Attorney made an offer to settle, which I replied was insuffiencent. His client had tampered the recording, removed the damning part. Up his offer, or we go to trial. He said he could not offer more. We went to trial. He was not there. The FAA attorney tried the case. He himself was a pilot, and sitting beside him, representing the FAA, was an FAA air traffic controller, himself a pilot, and the FAA’s chief witness against my client.
I told the former air traffic controller on the bus, that case broke my spirit, for I felt I had won it, but I did not. But here, on the bus, was a former air traffic controller telling me I indeed did win that case, the judge was wrong. I said I never had talked with an another air traffic controller about that case, after I lost it, and it was no accident that we were on the bus together and I was being healed of that awful sore on my soul. I paused, said, I took this talk on the bus to mean God really didn’t want me to be a lawyer, at least not that kind.
The former air traffic controller said the US Government does that kind of thing a lot. He has a lawyer buddy going back into the 60s, who complains all the time about the government tampering evidence, doing bad things.
We then somehow got to talking about computers, and I said, while I had a pretty good legal mind, and was a poet and a mystic, I was a mechanical retard, and my laptop needed help, it was dropping the internet connection. The former air traffic controller said he knows all about computers, let him look at my laptop, he probably can fix it in about an hour. quiet title actions are brought in court when there are competing claims to ownership of real estate, the action is brought by one of the claimants, the Florida Supreme court case might be prospective in application, not apply to disputed real estate claims already in existence. some constitutional restrictions on applying new legislation retrospectively

For some reason, I thought you walked away from your home and let the bank have it back. If it’s county code enforcement claiming a lien for unpaid fines, that’s something else, which the county commission can ultimately resolve, if you pay what they want you to pay, less perhaps than the total they are claiming in fines. I doubt a quiet title action will effect a lien for code enforcement fines.
Interesting thing this afternoon, I wasn’t paying attention and didn’t realize where the lower keys shuttle bus was until I was on Summerland Key. Got out at the first service station and started walking back to toward Cudjoe on the right-hand side with my thumb out, no luck. Then, I saw a deputy sheriff cruiser parked in the shade of some trees off to the right ahead, and I stopped thumbing and walked over and told the deputy my problem, and he said he could give me a lift to Cutthroat Road, which is the turn to where Todd German lives. But when he got to Cudjoe, the deputy made the first left turn, and then turned right and went down the interior road, and I said, I know this road, a biker chick picked me up down the way one day, and, dang, she emailed me this morning about maybe me staying in a house she has on Big Pine Key. Maybe that’s a sign. I earlier had told the deputy the weird events with my previous landlady, which had me come to live with Todd, and before that, that I’d lived on Little Torch and also in Key West.
Well, I don’t know what the spirits are up to, but feel free to write back, if you want more of my rusty legal thinking.

We did strategic default and the bank did too. Guessing the evil neighbours stripped the house. Medical costs. Can you get an Obama care policy on the next open enrollment? My son pays $53 a month after making $12 an hour 40 hours week. You need additional healthcare and should really ask step-mom to assist.

Okay done with the lecture. I am going to stand by on the ruling in November and may return to repair if it passes. If not, then we will make an arrange to donate the house since it is legally in my name and I cannot sell it.
Putting money in to it if I don’t get free title is retarded. We could have stayed there. I could have put in a renter or did a short sale. It was a terrible traumatic situation. Nobody helped me! I didn’t help me. Now with Mercury Retro I cannot think straight.

Hi -
Based on what you have written about your house, I don’t see a quiet title action. I see you maybe or maybe not working something out with the mortgage holder, or, if there was a foreclosure, with whomever acquired title then. And perhaps there is stuff to work out with county code enforcement. But it looks like a heap of time, trouble, worry, and perhaps money for you, and I don’t see, not yet anyway, why you need a lawyer involved, which might cost a bundle, if he gets paid for all the time he spends on it.
There is no telling Kari what to do about smoking and drinking. She does not even listen to the angels, or to judges, or to anyone. She is not smoking, nor is she drinking, in the jail. When she gets out of there, whenever that is, she will do what she wants to do. Hopefully, she will refrain from smoking and drinking, that will be best for her in all events. Hopefully, she will want to refrain because she likes other things going on in her life better and doesn’t want to lose them, which she will if she returns to smoking and drinking. Time will tell. If I spend a lot of time and energy worrying about it now, I might go nuts. If I don’t let it play out, I might blow something beautiful.
No telling what would have happened if my father had not paid for my education. Maybe I’d have ended up being a Keys flats guide. That’s what I really wanted to do, and later in life, when I was practicing law and not caring much for it, I gave a lot of thought to moving down here and being a flats guide.
The angels you told everyone on the Coconut Telegraph [www.bigpinekey.com] healed you after you and I made love, had me help one woman, Brenda, who would have been homeless, but for me, and other people, who were in financial straights. Maybe you should get onto those angels about that.
Todd has a robot vacuum cleaner, which tidies up the floors. I clean up after myself in the house, he cleans up after himself. So far, he has declined my offers to help with the occasional grass mowing. He likes yard work, tending to his many plants, shrubs and trees. I probably would fall out if I did much of that.
I work plenty hard, but it’s not visible. If you were put into my skin for 5 minutes, and had run through you what is run through me during those 5 minutes, you would go insane, and, if you were lucky, you then would die.
I explain that from time to time, but nobody down here, except perhaps Kari, seems to believe it. That woman I help out, Brenda, she believes it, because it’s happening to her. Like for me, doing secular work is very difficult for her, because of the spirit burden being run through her.
While I was poor and homeless, the angels went relatively light on me with the spirit burden. When I received the inheritance from my father on Valentine’s Day 2006, the angels ramped up the spirit burden considerably. They kept ramping up the spirit burden. Then, when Kari showed up a few months ago and we became a couple, the spirit burden eased some, or it felt like it eased some. I figured Kari started carrying some of it inside her, like Brenda carries some of it in her, as well as spirit burden having nothing to do with me.
This world has no clue what is really going on. Psychiatry remains in the cave man stage. As does religion. As does science. As does society. But for people like Brenda and me, humanity would be even more screwed than it already is, because then nobody would be working on what really needs to be worked on to keep humanity from going totally insane and just as totally demonically possessed.
Arnaud and Naja Girard asked me the other day, why I don’t start practicing law again? I would be good at it, it’s me, they said. I said, to do that in Florida, I’d have to take the Florida bar exam. To take the exam, I’d have to go through a serious background check by the Florida Bar Association, which would delve into my experiences in the hands of psychiatry and so forth. The background check might take a few months. If I passed that scrutiny, I would be given permission to take the bar exam. Then, I would have to study 6 months, to have a chance of passing it. There are bar exam courses, which would help me get ready to take the exam. I don’t have the money for the courses. If they are taught online, I would not have to travel to take them. If I took them, did the boning up, took the exam, it might be 2 months before the results came back. If I passed, then I’d have to be sworn in, probably in Tallahassee. No way I can get to there, for that, due to no money. But if I got around that, I’d then either have to land a job with a law firm, or the state attorney, or the public defender, or with a company needing in-house legal counsel. Or, open my own law practice, for which I have no money to do. To get through all that in Florida would require money I don’t have.
To return to Alabama and get caught up on my Continuing Legal Education deficit, which existed when I turned my law license in around the end of 1999, would cost a good bit of money I don’t have, but, unless the Alabama State Bar objected, that would be pretty straightforward to get me licensed to practice law in Alabama. But getting hired by a law firm or corporation, of the district attorney or the public defender, or a corporation would be another matter. And opening my own law practice would require money I don’t have.
I told Arnaud and Naja they had not asked me the correct question. Oh, what’s the correct question?, they asked. The correct question is, Do I want to practice law again? The answer is, no.
I’m reminded of when I returned to Alabama in 1995, from having lived in New Mexico and Colorado for 10 years, and not having practiced law in all that time. My father told me I should get an entry level position in a Birmingham law firm. I sat with that a moment, said, my heart just wouldn’t be in it. He lost his cool. I let him have it, said he’d never criticize me again in this life, because he would never see me again in this life. It would be better for us in the afterlife. I shook his hand, looked him in the eye, and told him goodbye. Immediately, he started coming to me in my dreams, being the father he probably had wished he had been to me, the father I wished he had been. He still does that.
As time passed, the angels tried different ways to unravel that, even as they gave me things to deal with, involving my father and/or his second wife, which were guaranteed to make sure he and I never would reconcile in this life, and we never did, even though I was making overtures, which he was using his lawyers to field and deal with me.
In fact, I was practicing law all along, but in God’s courts, not man’s. I’m still doing that. I’m not convinced practicing law the way I do can be merged with practicing law the way lawyers do. I think there would be too many conflicts of interests for the lawyers, between serving God, and serving the cannons of their profession. Or their wallets. Or their social standing. Or their family and friends. Jesus in the Gospels practiced law in God’s courts ongoing. How do you think he would have fared blending that with practicing law in Caesar’s courts? Well, we know how he fared in the Gospels.
Of course, if the angels told me to do blend the two ways of practicing law, to go through all that rigmarole of getting licensed to practice law again in Caesar’s courts, I would do it. I do what they tell me to do. Right now, they have me running for President of USA. Believe that or not. It matters not to me. But that’s what they have me doing, and they have Kari on the ticket as my Vice President running mate. Believe that or not, too. Angels do not think like people, thankfully. Otherwise, humanity would be a lot more screwed than it already is.
I think you might be biting off a lot more than you can chew, much less digest and eliminate, by trying to get something going again with your house down here. That’s with the bank and code enforcement. No way do I see the county letting you turn it into what you described in your second email today. What I see could be more of the same wrangling between you and the county, and you and your neighbors. That didn’t go to suit you before. Do you think it will go differently now? If Kari and I were living there, we’d not want that kind of local drama in and around our home. Nor would we want it going on next door, or within hearing distance of where we live.
You said to give you hell, be honest. That kinda how I tend to go about things.

Aloha and thanks for writing back Sloan. I bet you were a great lawyer. They are like rockstars to me. Would rather sit in a court than a movie theatre. My son would need $100 K just to get educated. They sure don’t make it easy. WHY IS EVERYTHING SO HARD? My friend became an attorney and my late father paid his law school and he too hated the job. Quit. Made bad real estate investments and then returned to Law as a personal injury atty.
The attorney said the house is still in my name because the bank does not want it and I could rent it out.
In November there is a case in front of Supreme Court in Florida about quiet title which will set a precedent.
The pros verses the cons for moving back do not add up. But like yourself, I am very much drawn to FLORIDA my whole life. Maybe from another life. I believe we return with our soul groups. SHARE more of your lifestyle of the rich and famous - it is interesting!! My parents were so low key we had no idea. Don’t know if that is good or bad. The rich sometimes think they are overly entitled and some of them park in the firelane, speed, treat others unkind like they are special - when they are not special!

As I recalled, you are a trust fund baby, or sorts. That has its ups and downs unimaginable to people who are not trust fund babies.
When I had to sell my place on Little Torch Key, at the last moment, I was able to talk Sandy Downs and her family into taking Miss Kitty. They didn’t want to do it, but then they fell in love with her. Sandy said, Miss Kitty moved in, the rats moved out. About 3 months ago, Sandy told me the next door neighbor had work done, and the workers took a shine to Miss Kitty, and after they were done doing the work and left with their tools and equipment, Miss Kitty was gone and the rats came back into Sandy’s home. I said I hoped whoever got Miss Kitty treated her good. All she needs is food and water, and to be allowed to hunt. That’s what she does, she hunts.
The first time I went to an astrologer was in early 1986, in Santa Fe. She was highly regarded, and known to bust her clients’ chops. I gave her the information she requested, and came back when she told me to come back, after she had done my chart. She was seriously subdued.

A Monroe County assistant public defender’s failed attempt to subpoena prosecutors in his DUI case could curb similar efforts by other defendants countywide.
Assistant Public Defender Matthew Matteliano, who was charged with drunken driving last year, alleges the State Attorney’s Office was unfairly handling his case. He tried to convince county Judge Peary Fowler on June 2 that he should be allowed to force State Attorney Dennis Ward and Assistant State Attorneys Christina McRae and Carla Matinada to state under oath why their office was prosecuting him.
“We wanted to ask what steps they had taken to ensure Mr. Matteliano was not being singled out and that they were not trying to make an example out of anyone in particular,” said attorney Bill Heffernan.
The issue goes back to Matteliano’s attempt to have the State Attorney’s Office recuse itself, in light of his employment with the Public Defender’s Office and his professional relationship with Florida Keys prosecutors, Heffernan said.
The judge rejected the motion, which Assistant State Attorney Mark Wilson said sets a significant precedent in the Keys.
“I think if the motion had passed it would have set a bad precedent, in the colloquial sense of the term, because had it passed, it would have opened the floodgates for every criminal defendant to subpoena members of the State Attorney’s Office and ask why they are being prosecuted,” Wilson said.
The reason people typically cannot do that strikes at the heart of the separation of powers between our branches of government, Wilson said.
“The courts’ arm of government obviously falls under the judicial branch, and prosecutors, like cops, fall under the executive branch. So this is what we call ‘beyond judicial review.’ In other words, the law typically does not allow for the judicial branch to be directing what the executive branch is doing and vice versa,” Wilson explained.
“There are expectations, but they are very narrowly focused. So the principle behind winning this motion is far more important than however Mr. Matteliano’s case is ultimately resolved.”
Heffernan did not argue the motion from that perspective, he said.
“We were not contesting Mr. Ward’s right to file charges if he has probable cause,” Heffernan said. “That being said, we felt it was inappropriate for his office to continue to handle this case.”
Wilson foresaw defendants filing similar motions, leading to an unbearable burden on an already busy Monroe County court system, though he added the principle of defeating the motion was his primary motivation.
“The state attorney would have to open another office to deal with the increased caseload,” Wilson said.
Exceptions include when a defendant convinces a judge that prosecutors are charging him or her based on their “faith, race or a desire to prevent the exercise of the defendant’s constitutional rights,” Wilson wrote in a footnote in his response to Fowler.
Matteliano wanted a prosecutor from another county to handle his case to “avoid the appearance of any impropriety,” according to his Feb. 16 motion. “My case is being singled out and prosecuted far differently than the average DUI case.”
Facts about his arrest were “leaked” to the press, Matteliano complained. The Citizen requested and received an arrest report from the Monroe County Sheriff’s Office on Dec. 20 and published a news story the next day containing information from that public record.
Such media reports have “prejudiced my ability to obtain a fair and impartial determination of guilt or innocence before a jury in Monroe County,” Matteliano said. “I have been made aware of the fact that several comments have been circulating throughout the judicial circuit suggesting that I ‘had this coming’ [and] ‘as a member of the criminal justice bar, I should have known better,’ and other comments that are couched in a negative light regarding my conduct,” Matteliano wrote in his motion.
Ward refuted those claims outside court after the motion was filed.
The Monroe County Sheriff’s Office charged Matteliano, 33, with misdemeanor DUI after a 2:30 a.m. wreck at Mile Marker 9 on Rockland Key, where they found a car he allegedly was driving about 15 feet off the highway and in the mangroves, reports say.
Matteliano reportedly told a witness he had been at a Christmas party.
He remains employed with the Public Defender’s Office.

If Matthew lives that, he won’t be anything like the kid in diapers lawyer who got wrote up in the Citizen and later claimed he defended Kari.
